Terms and Conditions

1. Acceptance of Terms

  • By enrolling a student in our program, attending an Einstein’s Horizon session, accessing our website, or purchasing, downloading, installing, accessing, or using any Einstein’s Horizon software or VR application, you (“you,” “parent/guardian,” “participant,” or “user”) agree to these Terms and Conditions, our Privacy Policy, and any other policies referenced herein.

2. Services Provided

  • Einstein’s Horizon provides immersive, VR-powered STEM enrichment programs designed for middle and high school students. Programs may include instruction in physics, biology, chemistry, and related subjects, delivered in schools or designated program locations.

3. Eligibility & Enrollment

  • Programs are open to students in grades 6–12.

  • All participants under the age of 18 must have a parent/guardian register and provide consent.

  • Enrollment is on a first-come, first-served basis and subject to availability.

4. Parental Consent & Student Responsibilities

  • Parents/guardians acknowledge that VR experiences may cause discomfort (e.g., dizziness, nausea, or disorientation).

  • Students must follow instructor guidance at all times. Misuse of equipment or disruptive behavior may result in removal from the program without refund.

  • Parents/guardians remain responsible for ensuring students are medically fit to participate.

5. Payments & Refund Policy

  • Fees, if applicable, are due at the time of registration unless otherwise specified.

  • Refunds are processed in accordance with our Refund Policy, available on our website.

6. Intellectual Property

  • All program materials, VR simulations, and curriculum content are the intellectual property of Einstein’s Horizon or our partners.

  • Parents, students, and schools may not copy, record, distribute, or modify any program content without prior written consent.

7. Software License and Permitted Use

  • Einstein’s Horizon VR applications purchased through the Meta Horizon Store or another consumer marketplace are licensed solely for individual, personal, non-commercial use unless otherwise expressly stated in writing.

  • A standard consumer purchase does not grant a license for institutional or organizational use. Schools, school districts, universities, colleges, tutoring centers, training organizations, healthcare organizations, businesses, museums, government entities, nonprofit organizations, and other institutions must obtain a separate Institutional License from Einstein’s Horizon.

  • Institutional use includes use of the software in connection with classroom instruction, organized training, demonstrations, educational programs, employee training, research programs, or other activities conducted by or on behalf of an organization, regardless of who owns the headset or purchased the application.

  • Organizations interested in using Einstein’s Horizon applications should contact Einstein’s Horizon for institutional licensing and pricing.

  • Except as expressly permitted under an applicable license, users may not commercially distribute, rent, sublicense, publicly provide access to, or use Einstein’s Horizon software as part of a paid or institutionally provided service.

 

8. Code of Conduct

  • Participants are expected to behave respectfully toward instructors, fellow students, and property.

  • Any form of disruptive, unsafe, or inappropriate behavior may result in removal from the program without refund.
     

9. Technology & Equipment Use

  • VR headsets and related equipment are provided for use during sessions and remain the property of Einstein’s Horizon.

  • Parents/guardians accept responsibility for costs arising from intentional or negligent damage caused by their child.

  • Students may not tamper with, modify, or attempt to bypass VR software or hardware.

10. Limitation of Liability

  • Participation in VR-based activities involves inherent risks. By enrolling, you acknowledge and accept these risks.

  • Einstein’s Horizon is not liable for injuries, health issues, or property damage arising from participation, except where prohibited by law.

  • Parents/guardians agree to indemnify and hold harmless Einstein’s Horizon, its instructors, and affiliates from any claims related to participation.

11. Data & Privacy

  • We collect limited student information (e.g., registration details, performance feedback) solely for program operation and improvement.

  • Data is never sold to third parties. See our Privacy Policy for full details.

12. Media & Photography Consent

  • During Einstein’s Horizon programs, students may be photographed or recorded for the purposes of promoting our educational activities on social media, websites, and other marketing materials.

  • By enrolling, parents/guardians consent to such use unless they provide written notice requesting their child not be photographed or recorded.

  • No identifying personal information (such as full name or contact details) will be shared without explicit parental permission.

13. Medical Emergencies & Consent

  • In the event of a medical emergency, Einstein’s Horizon staff may administer basic first aid and, if deemed necessary, contact emergency services (911).

  • By enrolling, parents/guardians consent to such actions and accept financial responsibility for any medical care or transportation incurred.

  • Parents/guardians must provide accurate emergency contact and medical information at the time of registration.

14. Scheduling & Program Changes

  • Program schedules, locations, and instructors are subject to change.

  • We reserve the right to cancel or reschedule sessions due to unforeseen circumstances (e.g., technical issues, emergencies). Notice will be provided as promptly as possible.

15. Force Majeure

  • Einstein’s Horizon shall not be held liable for delays or cancellations caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, labor disputes, or power outages.

16. Dispute Resolution

  • Any disputes arising under these Terms shall first be attempted to be resolved through informal discussion. If unresolved, disputes shall be submitted to mediation or binding arbitration in Orange County, California, under the rules of the American Arbitration Association.

17. Governing Law

  • These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
